ADMINISTRATIVE REVIEW TRIBUNAL APPEALS for Visa Refused or Visa Cancelled

Administrative Review Tribunal (previously known as Administrative Appeal Tribunal) is an Independent Body appointed by Government of Australia to process appeals for various kinds of matters including matters relating to Immigration Act 1958 and Regulations 1994 (Immigration and Citizenship matters) where visa refused or visa cancelled or citizenship refused or cancelled. When your visa refused or visa cancelled, first, you must read decision letter very carefully, and if you are allowed to lodge an appeal, you must lodge ART appeal within time limit permitted. ART Fee is very high AUD$3,496 and if you win aappeal you will get refund of 50% of fee paid. If you fail at appeal you will have opportunity to proceed with Federal Circuit Court, Federal Court and High Court  Appeal and you must be prepared to bear very high costs of appeals.

Visa Refusal by Department of Home Affairs, Australia will take place when you have not met requirements at the time of application, at the time of decision and at the time of visa grant. Visa application requirements also known as Criteria to be met with for application of visa, for example, visitor visa, student visa, partner visa, skilled migration, or work visa or any type of visa you have applied for.

Visa Cancellation by Department of Home Affairs, Australia will take place when you have breached visa conditions or provided bogus documentation or kind of behavior unacceptable in Australia and Dept has come to know about your application, you will receive notice of cancellation and if you do not respond or Dept is not satisfied with your answer, Dept will cancel your visa under various provisions of Immigration Act 1958 & Regulations 1994 and if allowed, you will have certain time limit to lodge your appeal to ART and you must lodge ART appeal within time limit permitted.

If you miss out on lodgment of ART appeal in time limit permitted, ART will not accept your appeal at a later date and you will lose your chance of appeal once and for all. You will not be able to lodge ART Appeal and it will be advisable you leave the country to keep your record clean. The STRICKETES time limits apply for lodgment of ART Appeals.

Currently, ART is processing Mountains of Appeals so processing is taking 2-3 years or more and you must be patient to wait till hearing comes for you.

If your appeal is accepted by ART, you should then submit the documents to support your appeal – first read the visa refusal or cancellation letter of Dept., find the reasons, and how best you can put forward your arguments and documents as evidence to support your appeal. ART will go through each document and information provided by you and when your turn comes conduct an interview either over the phone or in person and it is called Hearing of Appeal.
